QUESTION

CAN I SUE?

Asked on Dec 05th, 2013 on Residential Real Estate - Nevada
More details to this question:
I am a victim of domestic battery and under AB 284 I have a right to terminate the lease. So I gave notice to my landlord twice. once in the office in which I was rudely asked to leave on October 1st and after they had taken copies of my 30 day notice statement along with police report. I left the copies of my statement and the AB284 law and the report on his desk before he found out I was recording with my phone and I was rudely asked to leave. I served him with a letter stating my 30 day notice along with everything else we had copied by certified mail. I have copies of that and the signature stating it was received on oct 2nd. 2013. I moved out on the 21st, gave them the keys on the 28th and they refused to give me a walk through. On December 2nd I received a letter stating that my security deposit is being withheld because my lease doesn't expire until may 2014 and they are charging me for things that were missing or broken when I moved in. Can I sue For unscrupulous business?

While "unscrupulous business" is not a claim, failure to abide by AB284 for domestic violence victims and NRS 118A.242 regarding accounting for security deposits should provide you with actionable claims as against your landlord.
