I rented a room from someone off of Craigslist. Upon move in he did not have a lease for me to sign and said that we would just go month-to-month as long as I wanted. I wrote him a check for $1000 first month and a security deposit. Upon move in, I asked if they were clean and he said very clean and then I asked if he had animals and he stated all the animals that he had. Well- I'm allergic to cats, but he said not to fret the cats are outside cats and would not be coming inside. I hired professional movers and had them move me into my room. When I moved in, I figured out that there was no hot water for the sink in my bathroom. He said he’d fix it and never did. The first week was okay. Then second week I found out that him and his daughter are pigs. Someone slung spaghetti sauce all over the pantry and it was also on the floor (I have pictures). Neither of them cleaned and I found myself cleaning all the time because I don't live like that. He said he was sorry and would have his daughter clean more. Months passed, things progressed. His 17 year old daughter had underage parties with alcohol and he had guns not in a gun cabinet in his side of the house accessible to the kids. He made a few sexual remarks to me telling me he knew what my vagina looked like by some physical features, etc... Started talking to me like I was one of his male friends (I'm female) and talking about his sexual escapades, how he used to sleep with his old roommate, and had multiple women over. He treated his daughter like she was his wife (made her cook, clean, do his laundry, grocery shop, etc.) At this point, I knew that this wasn't the right fit for me but I held on for his daughter because I wanted to be there for her. I began thinking of her like my little sister. Well he started pinning me and her against each other and I finally had enough. I gave him a 9 day verbal notice and text notice. I have text messages and pictures. What legal action can I take to get my $500 deposit back?
Verbal agreement are hard to enforce. It's your word against his. The judge will have to pick. The judge will want to know if why you did not get a written lease.
You are entitled to the return of the security deposit even if you did not give 30 days? notice because he breached the agreement. You should send him a letter by certified mail demanding a return of the security deposit. Then, follow the rules for small claims court in Clark County Justice Court.
