Can my roommate sue over a sublet?

Can roommate legally sue? I Sublette a room in my apartment. We signed an agreement saying he would stay there 3 months. It's been just 1 week and it's been absolute hell. He as I later found out works from home so he's here 24/7, moved his puppy in who's been crapping all over the place, as well as his boyfriend and his dog., He's leaves the shower running for hours without even being in the bathroom, does 2 loads of laundry per day, constantly curses me out, smokes pot in his bathroom, keeps feeding my dog when I tell him not to who's been having diarrhea since he's moved in, goes on manic rages in the middle of the night screaming & shouting, went off on the building door lady who called the cops on him, etc. I told him he has to leave by the end of the month now he's threatening to sue me saying I can't legally kick him out because we had a written agreement. Does he have a case? And what can I do, Iโ€™m about to have a nervous breakdown over this individual!! And would it be possible to even kick him out earlier, like in 2 days? Heโ€™s only paid up until Tuesday then was going to pay for the rest of the month. But he's saying now he's going to keep the shower running 24/7 until he leaves! I really can't take this for a 10 days. Please help.

You are in the same position as a landlord is with a tenant. [I assume you had the owners permission to sublease if not then it was an illegal sublease and he can be forced to move out ASAP]. Give the tenant a three day notice to vacate due to disruption of your peaceful enjoyment of the premises and disturbing the peace [call the police on him]; it is not a curable offense but you may need the sheriff to kick him out. You should record how the inside of the house looks before you kick him out as he will likely breach things.

If he is smoking pot you can give him a 3 day notice and sue him for eviction as soon as the 3 days is up. Did you agree to his puppy and his overnight guests? if not ... you can sue him for breach in of the lease for not keeping the You might also be able to sue him for his puppy droppings saying the house is no longer habitable with his puppy there. I recommend you get an attorney.

You could initiate an eviction proceeding in Justice Court for breaching the lease. You could also call the police regarding the pot smoking.
