QUESTION

Can the recovery program I am in just kick me out?

Asked on Feb 22nd, 2017 on Landlord and Tenant Law - Massachusetts
More details to this question:
I am in a recovery program and have been here 9 months. The maximum length of stay is a year. Now my roommate assaulted me in my room so no one saw it. I left the room immediately and got staff and told them what happened. She told then I pushed her first when I never touched her. They kicked her out right away because she had only been here a couple of months and already got into multiple alterations. I didn't do anything wrong. I have 30 days to leave and can't graduate. I have never been in trouble before and am doing the right thing and get punished anyways. This place is harm reduction, so you get to stay say if you get caught shoplifting or if you relapse. You can graduate if you don't do it again. But I can get kicked out, and can't graduate, and I didn't do anything. They are going on what this girl who clearly has had issues from the moment she walked into the door says. I have had 5 other roommates not one issue with any of them. I just feel like this isn't legal. Especially when I have a letter they wrote for me when I went to the DTA office telling them that I pay rent to live here.

This is a very specialized area. It really relies on the terms of the agreement you signed when you moved in. Ordinarily they could not kick you out without a court order. I would seek the advice of a local legal services lawyer as you very likely have rights to reside that cannot be unilaterally taken away from you.
