QUESTION

Can't pay property Tax

Asked on Oct 16th, 2016 on Real Estate - New Jersey
More details to this question:
My father was suppose to sign over the deed to my house when I was 18 ordered by the court after we won our case. I was a child then. I am 22 now . He and his wife has been living in the house paying the property tax. I decided since I am married now that I want to take over the house. It is October and they just moved out but he hasn't paid the property tax and won't out of anger. He hasn't signed over the deed either. I don't know what to do. I have only been living here for a week now and I fear that I am going to lose my home. We live in the state of New Jersey and the property tax on the house is around $5,400.

You won't loose your house over that amount.  First there has to be a tax sale - that means an outside investor comes in, pays the taxes, and then gets a lien against your house.  Two years after buying the tax sale certificate, the investor can require payment or can force the sale of the house in order to get payment.  If your father refuses to sign the deed, you can go to court on a Motion to enforce litigant's rights, and get a court order that can be used in liue of his signature.
