QUESTION

Co owner does not want to sell house

Asked on Nov 18th, 2015 on Residential Real Estate - Pennsylvania
More details to this question:
I purchased a house with ex girlfriend 10 years ago. Both names are on loan. I never lived at the house, she lived there with family. I paid housing expenses all along. I want to sell. She won't sign the listing agreement. She does not want to buy me out. I cant trust her to keep payments up to date. She has neglected the property. I live 6 hours away and can't travel there for repairs. I have paid for major repairs through the years. I can no longer afford to support this property. What are my options? Thank you.

This is a really touch situation with no easy resolution.  If you allow it to continue, it may end up being an issue for you so long as your name is on the property and/or the loan is not paid off.  I would strongly recommend taking assertive action now rather than later.  You can petition the court to partition the property.  That means she either needs to refinance/buy you out or the house will be put on the market to be sold to the highest bidder.  I would recommend that you retain an attorney to assist with the process.  It is not a do-it-yourself matter.
