My HOA property manager has commingled my monthly maintenance fees with a special assessment fee. Shouldn't this be prohibited as I pay my Maintenance fee 3 months in advance? My maintenance fee for the 4th quarter 2023 was paid on Sept,17th and then applied to the Special Assessment fee prior to the assessment fee being due on December 01st. Isn't this wrong? No action has been taken, no paperwork prepared, just need an answer to my question. Basing my question on the new HOA law (FS 720) effective October 1, 2023, under Commingling of Funds.
