Condo Association Repair Neglect

I am purchasing a condo in Genesee County. My roof leaked, I properly notified my HOA, they did not repair it for months, causing damage to my living room ceiling. Our By-Laws state that "Immediately after damage of which the Association is responsible, they will obtain estimates and place the damaged property in a condition as good as that existing before the damage." They sent a fix-it man who applied apoxy down the middle of my ceiling and said it was the best he could do. I have a copy of our By-Laws, copies of our communication, and photos of the damage and repair job.

Most Condo HOA's designate what repairs are to be done by the Assoc and which aren't. Most provide repairs for roofs, walls and foundations. Before hiring counsel, I recommend you attend an association meeting and ask them to address your issue. Let neighbors know the Assoc is not repairing properties as required and ask they fix it right. The damage you describe directly affect the asthetics of your unit but be aware, most condo agreements provide that if you sue the association, you have to pay their attorney fees.  Best of luck to you.
