Trailer is stored over the winter off property. It is parked in the driveway for use during the week and weekends for work and family use. Prior HOA gave verbal approval for use. Current HOA is telling me to remove. We met in October and I agreed to winter storage off property. Now they no longer want the trailer even during summer use. Is the issue not past the statute of limitations since we have had approval and no contact for 6 years? The trailer is too large to store in the garage or sides of the home. Guidance appreciated. HOA has also not filed minutes of public meetings for over 8 months. Minutes published last year are not accurate or representative of community meetings.
You do not have Statute of Limitations protection.
The issue here will come down to a strict reading of the HOA bylaws.
If the HOA is acting outside of its power or is not handling your case properly (administratively) then you have a case which can be won against the HOA.
