QUESTION

Do I have a case?

Asked on Oct 07th, 2022 on Residential Real Estate - Michigan
More details to this question:
I purchased a home and moved in on 9/15/22. I had an inspection. The first time it rained 9/26/22 the roof leaked and there is evidence of prior leaking. The property was broker owned so they say they never lived there so can’t know that the roof previously leaked. The inspector also claims no fault of his. I just don’t know what to do.

Dear Lisa, It is hard for a roof to leak and the owner not know it. You have no real cause of action against the inspector because your damages are limited to the amount you paid them. Proving fraud on the broker is not easy. You definitely need to retain legal counsel to have any hope of recovering damages. Obviously, if it is a repair, that can be somewhat expensive, a new roof is very expensive. I hope this helps. Gilbert Borman
