My husband and I closed on our house in Colorado on 8/6/2013. On 9/12/2013 it rained pretty bad here and now our carpet in our basement is soaked. Our house is 40 years old and was a flip, so we need to know, if they "sealed" any crack and put new walls up and never disclosed the issue can we go back on the seller, contractors or inspectors. Our basement is 1,000 square feet and is now ruined and have the possibility of fighting mold. This is going to be a costly project and we just need to know our rights before we start ripping up carpet and tearing down walls
Samantha,
The likelihood is that you will be expected to recover for the damages from your insurance company. However, if you can prove that the seller or his agent knew that the work was done improperly and took action to prevent your discovery with the intent to entice you to complete the purchase with incomplete knowledge then you have a case. Or, if the area that leaked should have been discovered by your home inspector then you may have a claim against him for negligence.
Good luck on the clean up.
