I live on Long Island, NY and notified my landlord I will not be renewing my lease. My landlord's admin asked if they can show my apartment to prospective tenants, since I had mostly moved out. I informed her that they could, so long as they gave me reasonable notice to ensure I wasn't in the apartment at the time of viewing, but that I was not entirely moved out yet and still had some items to collect. I returned home this weekend to discover that they had emptied out my entire apartment and my belongings. No one ever called me to ask if they could enter, as promised.The admin told me the maintenance guy did it and should not have. I asked her to ship my belongings since it is no longer convenient for me to pick them up and she said she cannot take responsibility for this. I think that because they entered illegally and removed my possessions, the onus should be on them to either return my possessions to me or compensate me monetarily. Can you please advise what my rights are here?
It depends whether the lease had already ended when your belongings were moved, and how much time passed between your informing your landlord you still had possessions to remove and discovering them gone. Since your landlord stored your possessions, it's probably not worth the cost of the fight. Eventually they'll have the right to charge you for storage if the dispute isn't resolved. Make arrangments to go get your belongings.
