In my basement I have a sump pump system. A plug strip failed during the night. We noticed water starting to trickle into the floor drain. I want to be very clear, there was no standing water or "flood". The two bedroom closets where damp and I could tell that there was moisture under part of the wood floor around the bar. I called the insurance company, MY MISTAKE. They called 1-800 flooded, a "water mitigation company". They came in and quickly destroyed the entire basement. They ripped out all the wood flooring, all of the base board, all of the carpet padding(1000 sqft), took off all of the doors, cut big holes in two places to "look for water". They were running floor drying equipment every where, but the only place that had any moisture was in the 2 closets and bar area. They used a hammer to break holes in the wall so they could pump air into the wall, the wall where they found no water. One of the workers cut himself, then just wiped the blood on my wall. There is much more.
Yes, you should consider hiring an attorney so that you can get to the bottom of this. Once the area was dried then your insurance company should be assisting you in repairing the damage. Also, it appears as the mitigation was excessive and maybe negligent.
