I signed a lease back in Aug 2013 with the agreement that I could get someone to TAKE OVER on my lease, wasnt planning on being in the state for a full year. In Dec I found someone who was aprroved through my landlord to replace me. Last week he moved out saying the other roommate is threatening his life and now my landlord is trying to hold me responsible and demands I pay her rent today. In Dec she had my replacement sign a sublease, which I never agreed to, nor did i sign this new lease agreement-a sublease was never talked about and at this time it was to the best of my knowledge that my lease was terminated. In the lease I signed no where in it does it say anything about a sublease agreement. I would have never taken on that responsibililty knowing that I could be thousands of miles away. Can she hold me to this sublease and make me pay rent for the remainder my original lease?
The Answer to your question is dependant upon the exact language of the lease agreements. If indeed your landlord never actually released you from the lease and the lease term is still in effect you may be held liable for the lease. However, it sounds like there are others in the home who may also be liable. You may want to consult with an attorney if you landlord brings a suit against you to collect these charges.
