QUESTION

easement validity

Asked on Feb 03rd, 2014 on Residential Real Estate - Colorado
More details to this question:
electric company has documentation of an easement of an area in contention. the name and property description don't match, in other words the document has the name of the person that signed the easement but the property description is for a sub-division to the north. i know they have a prescriptive easement any where there is a wire for 10 feet but they are trying to claim this document is valid even though the owner and description don't match.

Robert, You may have a valid argument.  But, you 'll need to consult an attorney with the specifics to get a firm answer here.  Also, I'm not sure what you gain if you are correct.     Good Luck,
