When my dad passes I will own his 1/3rd ownership along with my uncle and 2 cousins who they share their 1/3rd. 1 cousin lives in the house & has for 3 years. They mailed my dad a letter saying they were going to work on finances to buy him out etc by getting a loan etc for $30K. They still havent. They dont want to move out and want the home to stay in the family because thats what their mom wanted. Sweet & all but dad and uncle feel they arent getting anything out of the house that was their parents but uncle wont get involved in forcing them out and dad has dementia and scared of them.. Dad and uncle are well in their 70's. Cousins in their 40's. So when dad passes and I get his 1/3rd is their a way I can force the sale of the home with them living in it? If a Judge says sell it will they be made to move out then sell it? Am I able to just let a attorney handle it and I don't even have see or speak to them?
