QUESTION

HOA Responsibility for hedge trimming at sidewalks for disabled homeowner or just for safe access

Asked on Nov 20th, 2013 on Real Estate - Colorado
More details to this question:
My question is regarding multiple requests to the HOA for trimming of hedges that have covered my sidewalk and my neighbors in condo building. The parking is directly in fornt of the sidewalks and the curb is located here as well. I have some mobility issues due to surgery and will be having more surgery. Access is difficult for able bodied people and dangerous for others who have impairments. Is it the HOA responsibility or not to keep sidewalks clear and accessible?

It is likely that the HOA is responsible, but there is no way to know for sure without reviewing the HOA governing documents.  If the HOA is responsible, you may want to have an attorney send a demand letter on your behalf explaining the liability the the HOA is incurring as a result of their failure to maintain the common areas. Good Luck!
