HOA Special Assessment/Assessment

It seemed that must questions were vaguely answered or not answered at all. There are now numerous assessments as well as special assessments transferred to the general assessment category. Levies include elevator replacement, roof repair/replacement, structural repair and other issues to be determined. These issues were not addressed as disclosures within the purchase agreement nor were the depth and breath of the issues addressed during personal inquiry. The initial Mortage company as well as “Freddy Mac” had questions as well. It appears that State of Michigan Statutes specifically address these matters.l within HOA/Property Management directives.

It is not clear what your situation is. If you just bought a unit in a Condo, all assessments and fees should have been negotiated as to whether they were paid by the seller or pro-rated at sale. You should consult with an attorney, as an owner you have rights but the Association has defined responsibilities.
