QUESTION

House Sale

Asked on Feb 17th, 2017 on Real Estate - Pennsylvania
More details to this question:
We have been promising we would be closing since last July. The buyers were getting and FHA loan we have been given the run around with appraisals and everything - had to do all of the repairs and kept being promised we would be closing. Now we find out that this may not happen after 8 months! The property needs to be sold to cover nursing home expenses from my mother in law and the rest would go to my husband. I have all of the emails and lies that were told to us documented. Is this something that we could have a case on? We even allowed the "buyers" to move in early because we were told e would be closing in a few weeks and that was last October.

You've got a complicated problem here for certain.  The buyers are residing in the home.  If the deal doesn't close, you have to figure out how to make them leave.  Hopefully they are paying you rent -- and if not, you should ask for that but only after you have a written agreement with them.  Selling the home may not be the ideal way of paying for nursing home expenses, especially if your mother in law is in skilled nursing.  I would suggest that you contact an attorney to discuss the real estate and nursing home situation as soon as possible.  If you're in the Pittsburgh area, feel free to contat me.
