How can you legally evict someone from your house?

Asked on Oct 26th, 2011 on Landlord and Tenant Law - Massachusetts
More details to this question:
I lived with my boyfriend for approximately seven years. It is over for good this time and I want him to leave. I bought the house my money and my name only. He will not leave and says it's his house too. We also have one child together.

You should get a lawyer. But, here it is: assuming he doesn't pay rent then he is a "licensee" whose license you may revoke at any time. However, you must give him ten days written notice to leave that is delivered the proper way by a process server. You then have grounds to evict. But, you should get a lawyer for that, too.

If his name is not on the deed to the house, you can start by having him served with a Notice to Quit. You should consult with a landlord-tenant attorney to do this properly as there may be details of your situation which may make this a little more complicated than it is in the usual eviction case.
