QUESTION

How do I have my 24 year old out as soon as possible?

Asked on Jul 29th, 2013 on Landlord and Tenant Law - Idaho
More details to this question:
My son is working, he is 24 years old not contributing to the bills, brings friends over to sleep and I can’t say anything about it otherwise I am cursed out. I am tired of living like this and am at my wits end. The room could be rented out to help pay my mortgage, which is in arrears now, I need help. I did not rent him the room he has lived with me all his life, that's my reason for placing the category as landlord and tenant nothing else fits the description.

He is a guest so you can give him a deadline in which to move out and then when he leaves the house change the locks on the doors. Tell him when you will put his clothing outside for him to pick up. You can call the police if you expect him to give you any trouble. You then may have to get a restraining order that he must stay at least 500 feet away from the house. Good luck.

That's exactly what you do; serve him with a 30-day notice to quit (since there is no contractual reason for him to stay). You can then have him evicted like any other tenant.

Give him a 30-day notice to quit and advise him that if he does not leave, you will go to court and have him evicted. Then do it.
