I owe back HOA fees (aprox 3 years). I did not intend to be delinquent, but found that not only do I owe, the HOA has placed a lien on my property and i am at risk of losing it. I admit i am not good with my personal finance but thought I was on autopay. I value my community and want to take responsiblity. The dues owed are aproximatley $4750, the late "fees" are over $5000 and the legal "fees" are over $2000 (as i was told generally by the collection firm). I am the only community member who has offered to pay their back HOA fees and have been more than forthcoming than the builder who owes over $400K in back dues (not including fees... my neighbor is on the board and has given me files to prove) To add insult to injury, money is missing from the HOA fund, I have done work (trim shrubs, weeds, etc) thats supposed to be part of the HOA, was told the sprinklers would not be fixed (so i watered), and no action was taken when my dog cut his paw on edging that was inproperly installed.
It is likely that your HOA will negotiate a lower settlement than the $11,750 you mention in your request.
Additionally, we may be able to bring a countersuit to attempt to bring them to the table.
We should discuss this over a free consultation to discuss your specific facts. I think I can help you and deal with HOA's regularly. Call Michelle, our receptionist, to schedule a consultation at 303-688-0944.
