I cosign for my daughters apartment three years ago. She is now behind on her rent and her landlord constantly calling me and threatening me about taking me to court because they know I owe my house recently. They sent my daughter a letter increase in her rent, and she had the choice even to agree with it, or to move, so she signed to agree to stay but my name was nowhere on the letter. I didn’t sign anything agreeing about the rent going up.Am I I still responsible? He will not let me take my name off this lease and I don’t know what to do. Can you please help me
The problem with cosigning anything is that you are taking on the responsibility of payment if the person primarily responsible doesn't pay. See if you can work things out with the landlord regarding the past due rent. It is not likely that he will agree to remove you from the lease. Your daughter could also apply for ERAP the Emergency Rental Assistance Program. Contact your County Bar Association to get information for a non-profit that can assist your daughter with the application.
