QUESTION

I started an accidental fire in friends apartment

Asked on Apr 28th, 2013 on Landlord and Tenant Law - Nevada
More details to this question:
Whle visiting a friend in their apartment rental, I accidentally started a fire in the oven while reheating food. Before I turned oven on I removed many pans, glass dishes and plastic containers that was stored inside oven and the friend said make sure I remove everything from oven. I did that but did not check the broile oven located below the oven of this gas type oven and later once fire started realized that too was full of plastic and wood containers. Unfortunately the smoke detector failed to go off and later found out that batter was missing in smoke detector. I would like to know who is liable for the damages, the friend who is the tenant, me who started the fire or the landlord who failed to have batteries in the smoke detector. Please note they just moved in a few weeks before the incident.

While liability will likely be allocated between the three of you (Landlord, Tenant, you), based on the allegations made, primary liability would appear to lie with the person who had the opportunity to prevent the fire (as opposed to detect the fire once it started).
