I am trying to evict my 41 year old daughter from my home. She is unruly, and constantly and consistently disturbing the peace and undermining and defying mine and my wife's authority as the homeowners. She lives in the same house as us. There was never any contract or lease signed. She is no longer welcome in our home. I called the cops to have her removed, but they said she had to be evicted through the courts like a regular tenant. Since September 2014, she has paid only 1 month's rent and that was in March of 2016. She hasn't paid anything before that going back to 09/2014, nor has she paid for April 2016 yet. I am planning on sending a written eviction notice to her by certified mail. Does it absolutely have to be her that signs it? If she won't sign it, should we also refuse to sign it and force her to pick it up at the post office? And if that's what we should do, what if she never picks it up at the post office? How will the judge look at that situation regarding the written notice if she claims she never got it?
