QUESTION

Inherited home in 55+ community; Not 55

Asked on Dec 05th, 2013 on Residential Real Estate - New Jersey
More details to this question:
I inherited my parents home, when they passed away, at the end of 2012. The house is in a 55+ community but I'm 52. I've been living in the house since 2008. I moved from Colorado to be closer to my parents due to their diminishing health. Can the HOA force me to leave my home? Thank you, Alan Patlen.

Probably not.  55 and over communities are not reserved EXCLUSIVELY for those 55 and older.  A small percentage of residency is reserved for those under 55, even minors.  You should be fine, but if the association acts to have you removed, ask to see the demographic age make up of the residents and seek an attorneys assistance if needed.
