QUESTION

Is this trespassing?

Asked on Nov 10th, 2013 on Landlord and Tenant Law - Idaho
More details to this question:
The property next to mine is a rental. The new tenants are leaning their tools against my privacy fence which is along the property line. I am the only one who takes care of the fence. I wouldn't make an issue of it except that I believe the tools are scarring the slats and I don't have the funds at this time to replace them. Is this a form of trespassing? If not, can I still ask them to remove the tools? I haven't been able to find anything in city or state ordinances about it.

If the fence running along the boundary line, then they are entitled to rest the tools against their side of the fence, as long as it does not damage the fence.

It's not trespassing, simply ask them to not lean their tools there.

It is on their side of the fence and on their property, so it is not trespassing. Have you asked them to move the tools off the fence? If they refuse, send them a bill for replacing the slats.
