i TYPICALLY PAY RENT THREE MONTHS AT A TIME I HAVE ONLY BEEN LATE ONCE AND PAID THE LATE FEE ON TIME OCTOBER 6 I WENT IN TO PAY ONE MONTHS RENT WITH A MONEY ORDER FOR 895.00 I HAVE NEVER BEEN GIVEN RECIT AND TOLD TO KEEP MY MONEY ORDER BACK PART WITCH I DO A FEW DAYS LATER I GET A CALL ASKING WHEN I WILL PAY RENT I ENFORMED HIM I DID HE STAYED HE NEVER GOT IT I PAID THE LADY AT FRONT DESK AS ALWAYS I GAVE HIM COPYS THEN OF THE MONEY ORDERS AND TACKED THEM DOWN HAVE NOT BEEN CASHED I CALLED HIM TOLD HIM I CAN CANCLE THEM AND GET REEMBERCED HE STATED THAT HE WOULD NOT BE ABLE TO WAIT THAT LONG AND HE WOULD BE POSTING EVICTION NOTICE SOON AND SUGEST I BARROW THE MONEY FROM FAMILY HE SAID HE NEEDS PROOF I FILLED IT OUT TO HIM AND THAT HE IS GETTING PRETTY TIRED OF ME ANY WAYS HE ALSO STATED THAT HE HAS LOOKED AT A FEW OF THEIR RECORDING FROM CAMRAS THAT DAY AND DOESNT SEEM TO FIND ME I TOLD HIM MABEY TO LOOK A LIL LONGER AT THAT DAY HE BECAME UPSET AND SAID HE NEEDS ME TO HAVE MORE PROOF
You will have to prove that you paid the rent. Did you get a receipt? Unfortunately, money orders are very similar to cash in that they are difficult to track and stop payment on.
If your landlord believes that you have failed to pay rent he can proceed to initiate the eviction process. You will need to Answer the Complaint by the deadline or you may loose possession by default. If you file an answer you will get a trial to tell your story to the Judge and the Landlord will have the burden of proof.
