QUESTION

Landlord refuses to give Deposit back.

Asked on Mar 28th, 2024 on Landlord and Tenant Law - Florida
More details to this question:
Back in November 2023 we gave a deposit to buy a mobile home and signed the contract. In that contract it stated the if the contract was terminated by at landlords fault, the money had to be returned in 0 days. We where also evicted without proper paperwork from the landlord and in the contract it stated that in any case of eviction we where to be given a certified letter notice by certified mail (which we never got). We have proof and all the paperwork showing that they are evading to pay. They also made me sign another contract under pressure saying that they would pay me in march but still I haven’t receive payment. And that if I didn’t sign they wouldn’t pay me at all so we ended up signing. Now they want us to sign another contract but we don’t want to.

You will need to hire a tenant lawyer or real estate lawyer to address this. If you had a contract to you buy the trailer then there is a potential argument that you were not subject to an "eviction."
