While you might not be ultimately liable, one of the purposes of insurance is not merely to protect you when you are liable but to quickly and expeditiously step in when you need repairs made. With that being said, a landlord must maintain a unit to be habitable. A property is not habitable when (1) it violates provisions of housing or health codes concerning the health, safety, sanitation or fitness for habitation of the dwelling unit, or (2) inter alia substantially lacks adequate plumbing.
