QUESTION

Our HOA and my husbands employment

Asked on Dec 09th, 2013 on Residential Real Estate - Colorado
More details to this question:
My husband is a tow truck driver and in this line of work, he has to be able to be on call four nights a week and this requires him to have his truck with him four nights a week. We live in a HOA that is fining us currently because he has to have his truck four nights a week and this is required by his employer or he will be let go. Can the HOA really keep him from working or force him to change jobs? We make a great income and want to live in a nice place but there is not a HOA here in Castle Rock, Co that will let him keep his job.

Unfortunately, the answer to your question depends upon the HOA not upon State law.  However, you may be afforded some protections under CCIOA.  I would be surprised if there is no way to work this out.  However, you may need to hire an attorney to defend you against your HOA's aggressive behavior. I'm in Castle Rock, I'll give you a free consultation if you want to discuss this more indepth. Don Eby 303-688-0944
