QUESTION

Owner Vs. Property Management CO.

Asked on Nov 27th, 2013 on Landlord and Tenant Law - Nevada
More details to this question:
I signed a 1 year lease with a property management company (PMC) & moved into the property on 9/30/13. on 11/19/13 I received a certified letter from the owner stating he has cancelled his contract with the PMC & he is in the process of short selling. he would like me to forward all future payments for rent to him directly & set up an appt with his investing agent (IA) to come into the house for pictures. When calling to confirm this information with the PMC. they confirmed the short sell and told me to meet with the IA, but told me to continue paying my rent as usual, that what he is doing is illegal. Met with the IA no pics were taken, she informed me that the owner cancelled the contract with The PMC the first week in Oct. The PMC never informed him that there was a tenant in place. that the owner hasn't seen a penny of the rent, or security deposit. I just need to know who to pay my rent to without breaking my lease. what options do I have? not my mess I want out.

You should continue paying your rent to the Owner who has the rights to the Subject Property.  This does not mean that the PMC may not commence eviction proceedings against you; however the PMC is merely an agent for the Owner.   Should the PMC wrongfully commence eviction proceedings, you will have an absolute defense so long as the rent has been properly paid to the Owner.
