Possible deception/Broken contract,

More details to this question:
Tried to rent a house, 1st house was rented after we put a small deposit down, agreed to a different house for more $ per month. Turns out he didn't own or have the right to rent out after we signed a contract & paid all fees and first months rent for a total of $2695.00. Now we are asking for ALL of our $ back he insists we pay a $100 service fee, or accept a different house. I do have his phone # and name Can anyone help me ?

You will need to spend the money to hire a tenant lawyer to intervene and address this directly. That the LL seems not to have had the right to rent the property is a problem.
