Question for issue with builder

Asked on Jan 17th, 2016 on Residential Real Estate - Texas
More details to this question:
Hi, I would like to know whether I can issue my situation or not. I heard from my builder that my permit had rejected from the city. I have been working the plan with this builder since last year September. Now, they told me the plan can not meet an allowable Impervious Cover percentage overage. They told me that they already had known that we are little over 4%, but they wanted to try to get exception. Now, they ask me to choose some other option to reduce the foot print or pick different plan. Thanks, Jung

Builders try more often to get away with stuff like this. A lawyer needs to review your contract. Suing them will only protract your problem so it is best to avoid it if possible. Settling is usually the way to go even if it does let the homebuilder off the hook a bit.
