Real Estate Reimbursement

Hi! I have inherited a property along with others parties. HOA fees were behind, it was mentioned that no had money for the fees so I paid it. One of the people agreed to help pay it. This was almost 4 years ago. I was intending to keep the property but changed my mind. Fast forward, mortgage is behind so I apply for a modification. My aunt filed for a partition around that time. Around 4/2024. So I stopped paying the mortgage. Fast forward, she let my uncle into the house to live since he’s on the deed in 7/2025. He was against the partition but was listed as a plaintiff. Can I sue them for estate expenses like the HOA fees from 2021, lawn care, partition court costs and the utilities of the home since he moved in?

As part of a Partition Action is an accounting of expenses.   In general, a co-owner can be entitled to reimbursement for real estate expenses such as real estate taxes, insurance, mortgage payments and yes, HOA fees. A petition for reimbusement/accounting would have to filed with the Court.
