Regarding my tenant

More details to this question:
I have a tenant in my home in NJ since September 2014. When he moved in, he had signed a one year contract. However when the first year expired, he never signed the contract in spite of repeated requests. I am out of the country since December 2014 and I could not enforce the signature. He has been paying the rent every month on time. Since he does not have a contract in place, can I give him a 2 months notice to vacate the apartment?

Yes - once the contract expired it can be a month-to -month lease.  you should indicate that the lease is now month to month and send him notice to vacate.
