QUESTION

Resident responsible for flood damage

Asked on Dec 23rd, 2013 on Landlord and Tenant Law - Colorado
More details to this question:
During heavy rain the basement window leaked and caused mold and damage. I reported the leak promptly but the landlord was unable to get someone to repair the damage. Since a GC was not available he asked me to remove the carpet. I did what I could but mold still occurred. The landlord withheld my deposit claiming negligence for not removing the carpet. Am I liable for this damage?

It is unlikely that your landlord can legally withhold your security deposit based on the facts you present.  You'll need to dispute this withholding.  I recommend consulting with an attorney as you may be able to obtain triple the wrongfully withheld amount in addition to the costs of your attorney.   Good Luck!
