QUESTION

Seller misrepresented issue

Asked on Feb 07th, 2022 on Real Estate - Michigan
More details to this question:
I recently bought a home and the sellers stated on the disclosure that there was previously a main sewage issue causing water in the basement however they hadn't had issues since. 2 weeks into moving into the home I had sewage coming up into the basement. I spoke with the neighbors and they told me the sellers knew this was an ongoing issue that was never fixed, and they were upset that they weren't told when they bought the home either.

Based on these facts, it is not clear if you have a cause of action or not. To prevail, you are going to prove that their disclosure was knowingly insufficient. Have you figured out what the exact issue is and the cost to correct? It might be cheaper to spend the money to fix it than hire a lawyer and, hopefully rescind the agreement. More information is needed to know the right course of action.
