More details to this question:
Me and my x have been seperated almost 3 years. We are both on the title and deed. I left since he was suppose to assume the mortgage. He was denied. I am trying to buy another house but need this one off my credit before doing so. He willnt let me assume the mortgage and keeps playing games about selling. I just want to cut our ties with this property.

You may have to go back to court - through your prior divorce complaint - for what is known as "post judgment relief".  you would specifically be asking for a court order to address the issue of the house.
