Signed a contract on December 08, 2016 with Close of Escrow January 12, 2016. Cooperative unit held in Trust. I am one of two Trustees-- the Sellers. Buyers failed to complete their loan paperwork. I was told by my real estate agents to move before end of January 2016. I did. The home is unoccupied. Real estate agents and Trustee #2 still do not want to file a Notice to Perform. Real estate agents did not want to ask Buyers for reimbursements caused by the failure to meet terms. They finally agreed to write an amendment but Trustee #2 will not sign. I want the reimbursement and a notice to perform.

How much are you asking to be reimbursed?  If this is less than $10,000, then you have a small claims case.  Write a demand letter and if you don't get paid then file a small claims action. As for the notice to perform, you can talk to the managing broker of your agent to discuss the breach of fiduciary duty for not representing you.  That should get them to issue a notice to perform.
