For over a year and a half my house was flooding as a result of the negligence of the HOA and management company. Several complaints had been filed. Finally stopped the flooding but the damage to the inside of my home is becoming hazardous. The whole southwest corner of my house has been effected and they are claiming that it is not their problem. However, their negligence is what caused the repeated water damage to the inside of my house. Is there anything that can be done to get them to take responsibility for their failures and to have them fix the damages that they caused? It does not seem right that the homeowner must take responsibility for the errors of their ways. I pay into the HOA for them to take care of the exterior of the home and because they failed to do so the inside of my home is now deeply damaged. Please let me know if anything can be done to have them repair what they have damaged.
If you can prove that "but for" the negligence of the HOA your home would not have been damaged then you can win a suit against your HOA and force them to pay for the repairs. The likelihood is your HOA has negligence insurance.
