QUESTION

What can I do about untrue claims on a security deposit?

Asked on Feb 27th, 2021 on Landlord and Tenant Law - Florida
More details to this question:
I received a Notice of Intention to Impose Claim on Security Deposit from my previous landlord. The claim has itemized deductions. Some of them I agree with because there was damage to the carpet. We lived there for 5 years. But there are some that are untrue. 1. Clean inside kitchen/ bathroom $150 and 2. Clean kitchen cabinets $140- this is untrue because I cleaned the place before I left and I took pictures as well. I am also being charged to replace the screen on the back porch $200. However, on our original walk-through the porch screen had several holes in it. We lived there for 2 hurricanes and the porch screen became unattached. I have a copy of a maintenance request form to prove this.

YOu can hire a lawyer to sue over this and try to force the LL to reimburse legal fees if you win. Otherwise, there is no real incentive for the LL to negotiate as they are just giving you your own money back if you win. The exposure to legal fees is the only thing that changes that equation.
