QUESTION

What rights do renters have when living under an HOA?

Asked on Oct 17th, 2013 on Landlord and Tenant Law - Colorado
More details to this question:
We signed a 2 year lease in June. When we signed, we were very upfront that we have 5 vehicles (we are living with adult brothers and sisters to combine living expenses), and we were told nothing about an HOA of any guidelines they have. Since then, we have been harassed nonstop and now are bing fined for some of our vehicles being parked on the street. It's not anywhere in our lease about parking regulations, or about an HOA or guidelines. We really have no other options as our garage is being used for storage. We have nowhere else to park. We would not have moved in here had we been informed and are being harassed by both the HOA and the management company. What are our rights and do you have any suggestions. We've contacted the HOA repeatedly and they won't call or email us back. The one time they did, they aside e have no rights because we're renters.

I think I answered your question previously on AVVO. The issue here is that your landlord is obligated under the HOA rules.  If you violate the rules of the HOA causing him to be fined he will likely pass that fine along to your and eventually be forced to evict you.  If you want to stay I recommend moving the storage from your garage to a storage unit so that you can park in the garage and driveway.  Good Luck
