The weekend we moved into our condo, we experienced major flooding due to rain leaking in through the wall. This wall faces the common courtyard. We also had water coming through the ceiling from the unit above us, again due to leaking coming through the condo structure wall. We had to tear out the carpet and, having gone through flooding in a previous apartment, I know that the walls and ceiling will absolutely need to get replaced. The HOA mgmt. company has stated that they will pay the $500 toward our deductible and that is it for internal damages. The issue is that our insurance does not cover flood damages caused by rain, only by plumbing issues. But I feel we shouldn't even have to go through our insurance since the water seeped in through walls that weren't up to par. The extra kicker, a neighbor mentioned that previous owner had been experiencing issues with this. This wasn't disclosed to us. What are our legal options here? Who should we seek reimbursement from?
If the leak resulted from an area of the building that the HOA has the responsibility to maintain they are likely to be responsible for the damage.
