QUESTION

Can a disability attorney cancel an ssi disability hearing without the clients consent?

Asked on Dec 12th, 2017 on Social Security Disability - North Carolina
More details to this question:
I have been represented by a certain law firm since 2015 when I filed for SSI disability. I received two notices from Social Security that my claim had been denied. A hearing before a judge was scheduled. One week before the hearing my attorney informed me that she was cancelling my hearing because she felt we could not win. She did not seek my permission to do this. The firm had access to my information for some time before the hearing. Was this ethical? I live in NC. The lawyer is in Tennessee.

The attorney should always consult with his/her client prior to rescheduling a hearing.  Even if they feel the extension is in your best interest they still need to communicate with the client.
