QUESTION

Do we have a case to move forward on?

More details to this question:
My wife was diagnosed with cancer, chronic lymphocytic leukemia, in 2012. We applied for ssd then and would have possibly qualified had our doctor been on board. We were denied and denied on appeal. Most recently a friend Whose wife recently died of cancer recommended that we apply again. So we looked into it. Both her local doctor (the one who was not supporting before) and her specialist from MD Anderson.,They both agree she canโ€™t travel and work and will need to be on treatment. We checked with a claims specialist and she indicated that my wifeโ€™s work credit were not enough now. The issue is back in 2012 until 2019 she had tried to work but has continually battle com plications from sickness and fatigue due to cancer so her work has been majorly impacted. She would work but was not able to retain continuous work because of an immune deficiency., now she canโ€™t. The frustrating thing is if a doctor would have supported us we would not be here. Is there a case?

Hi Mike, very sorry to hear of your wife's condtion. She may be able to apply and receive SSI benefits. The way SSA is constructed would not allow her to apply for SSDI.               Scott F. Bocchio, Esq. 855-254-7841

Social Security Disability Insurance is available to people who have worked and paid in the required number of quarter or who are dependents of someone who has. Supplemental Security Income is available to people who have contributed less or who are dependent on someone who has contributed less.  Unlike Social Security Disability Insurance, it has strict requirements with regard to income and assets. Whether your wife would qualify on these bases cannot be determined based on the information provided.  You might want to consult with a member of the National Organization of Social Security Claimants Representatives.
