Does this constitute a fraud case against the bank?

More details to this question:
Shasta is on disability due to injuries and mental damage . Mary is set up as "guardian" and receives the money for Shasta and distributes it accordingly. the benefit checks are sent in the name "Mary M. for Shasta A." and are directly deposited to a so named account. Shasta recently went to a bank and opened a new account and had the direct deposit of the disability benefits routed to this new account without Mary''s approval and without Mary''s signature

I would need a lot more information to give you a specific answer.  I need to know how Mary was set up as a guardian and why she was set up as the guardian.  Sometimes, Social Security requires a Claimant to get a guardian or someone to manage the SSDI or SSI checks.  I would need to know if a Power of Attorney or Legal Guardianship was set up.  If not, then this could just be a voluntary agreement which could be canceled at anytime by either party.  Shasta is allowed to set up a new account.  However, I am not sure how she would be allowed to set up the direct deposit to the new account without the Guardian's consent, especially if Power of Attorney or Legal Guardianship was done.  Mary needs to go to the bank and request copies of the documents that were filed in order to change the direct deposits.  The Bank will investigate fraud and could freeze the account and there were any irregularities.  Please visit our website for more information: http://workerscompfl.net/services/social-security/ Please call me for a FREE consultation at (877)817-4127.
