I was disabled 13 years and am unable to work. I recently filed for disability and was denied because I havent worked 5 of the past 10 years. How can I appeal this? I didnt file for all these years because I didnt need it, but now that I actually do need it I'm being denied. Had I applied for disability right after my injury I would have recieved full benefits , but because I didnt file I'm now penalized for not doing so? I can't make sense of this logic.
SSDI is available to people who have paid into the system for at least five of the past 10 years. You should have applied earlier. Many people find Social Security rules counter-intuitive. If you would like to discuss this with an attorney who specializes in the area, you might find one using the website of the National Organization of Social Security Claimants' Representatives.
