State does not recognize same-sex marriage, not even those performed in other jurisdictions. He is long-term unemployed (> 8 years) and does not have any employer based medical insurance coverage. He is also not eligible on my employer-provided health insurance at this time. I have been claiming him as a dependent on both my Federal and State Income Taxes for well over ten years. Long before he ever enrolled in any of the following government run/mandated health insurance plans. His medical coverage was being provided under a county program known as "Livingston Plan A", then the State discontinued that plan and rolled him into the Medicaid program. They directed him to enroll in an insurance program administered by UnitedHealthcare (their UnitedHealthcare Community Plan/Healthy Plan). This was the only option he was given or that was available. He has recently been contacted by a representative of the State Department of Health and Human Services (who administers the above Medicaid program). They are asking for my income information and are implying that my partner will be kicked off the UnitedHelathcare plan because my income now has to be considered for his continuing eligibility under the plan. When I spoke to this representative, she told me that this was because everything was being run under the Patient Protection and Affordable Care Act (PPACA) (a.k.a. the Affordable Care Act or "ObamaCare") and that the rules had changed and my income now is required to be considered. Although I did not give the rep any detailed information about my income levels, I am sure that my partner would not qualify for coverage based on my income. Instead I asked for her to send her request for this information in writing. What are our options to keep him covered for medical insurance and can they come after me to repay the state.
