QUESTION

Substituted Judgement by the Court

Asked on Dec 18th, 2020 on Asset Protection - California
More details to this question:
My mother named me as successor trustee of The Haffner Trust, u/a dated 12/2001, as well as executor, POA financially and Healthcare and. In Trust it states that should she ever need a Conservator, she named me. I filed in court to be Conservator, then my sister also filed. This sister had taken my mother to an Attorney, drew up new documents, naming herself, put her in a home then stole my mother’s property from her home. The court did a Substitution of Judgement, and now I am not trustee, Conservator, etc. How can I fight this judgement. They appointed a Conservator/Estate, and I believe he is not handling it right, I.e., why is he naming beneficiaries to an asset when the assets already names the Trust as beneficiary. He is not reporting all of her assets on the final inventory, even after I sent him a 1099 of a $600,000 asset? Something is really wrong here. What should I do?

I would have to review all the documents from Haffner Trust, u/a dated 12/2001 to the present.  Please call to discuss.
